Terms & Conditions

By using the services offered on helloradius.com or any Hello Radius Platform (the “Services”) and/or accessing our Platform, you agree and accept these terms and conditions in full and enter into a legally binding agreement with Hello Radius (the/this “Contract”).

 

This Contract sets out the terms and conditions that apply to your use of the Services and our Platform.

By referring to “Hello Radius” or “we”, “us”, “our”, we refer to HELLO RADIUS LIMITED, a limited liability company registered under the laws of the Republic of Cyprus under registration number HE 425388 which is the provider of the Services on the Platform.

The Contract covers all Services currently provided by Hello Radius, as well as any additional Services that Hello Radius may make available and provide in the future. Hello Radius has the right to modify or discontinue any of the Services.

By browsing or signing up (creating an account) to use the Platform and/or using the Services, you also agree to our Cookie Policy and our Privacy Policy which are incorporated and are part of the Contract.

Hello Radius reserves the right to modify the Contract, our Privacy Policy and our Cookie Policy at any time. You will be subject to the Contract in the form that is in force at the time that you use or visit the Platform. If modifications have been made, the modification date will be made visible to the User or Visitor on the Platform, where relevant. The User or Visitor is responsible for checking the relevant pages for any amendments and updates.

If you do not agree with the Contract, our Privacy Policy and our Cookie Policy, please do not register to use, or continue to use the Platform and the Services.

If you are an existing User, you can terminate the Contract at any time by deleting your account and by discontinuing to use the Platform and the Services.

 

Definitions

The following definitions apply to this Contract, unless a different meaning is given to them:

"Account Owner" means the primary user who created an account for an Employer / Recruiter and registered such company to use the Platform and the Services. The Account Owner serves as the main user and administrator of that account (even if additional users are added), responsible for managing multi-user permissions and overseeing the usage, access, and configuration of their account.

"Document" means any material entered, submitted or uploaded by any User on the Platform, including the details of a Candidate Profile, the description or details of a job advert, or about an Employer, or a company.

"Employer" means a User who accesses the Platform and uses the Services for recruitment purposes, such as managing job listings and applicants, contacting Job Seekers and offering employment. The term “Employer” refers to both the legal entity being the Employer and the physical person(s) who accesses and uses the Platform on its behalf, as applicable.

"Job Seeker" means an individual who accesses the Platform to search for jobs to find employment and/or apply to job adverts.

“Personal Data” has the meaning given to it in our Privacy Policy.

“Platform” means the Website, any application developed by Hello Radius or any other platform where the Services are offered by Hello Radius.

"Recruiter" means a User who accesses the Platform and uses the Services for recruitment purposes on behalf of their clients. The term “Recruiter” refers to both the legal entity being the recruitment company and the physical person(s) who accesses and uses the Platform on its behalf, as applicable.

“User” means a user of the Platform and the Services that has created a Hello Radius account, either as an Employer / Recruiter or as a Job Seeker. In the case of an Employer / Recruiter, the term “User” includes the legal person being the Employer / Recruiter and the physical person creating the Employer account / Recruiter account, as applicable.

“Visitor” means an individual browsing and using the Platform and the Services (the parts and information that is accessible) without having a Hello Radius account.

“Website” means helloradius.com.

 

User Terms

The use of the Services is only for adults (people aged 18+) who are either Employers / Recruiters (themselves or the legal entity on behalf of which they act) or Job Seekers (physical persons) and are subject to following conditions:

(a) your Hello Radius account is in your real name (and in the event of an Employer / Recruiter, in or indicating the Employer’s / Recruiter’s real name) and you protect and keep confidential your account information and password;

(b) you provide a genuine (not temporary) email address for authentication purposes;

(c) you confirm that if you create an account using your Google account, then you automatically agree to our Terms & Conditions, Privacy Policy and Cookie Policy;

(d) you are solely responsible for the information and documents you submit and publish on the Platform and, where applicable, you have any necessary authority and consent to do so (for example, from the company being the Employer / Recruiter);

(e) you are solely responsible for updating the information you provide on the Platform, and in the case of an Employer/Recruiter, any job adverts you publish and to remove a job advert if the job is no longer available for any reason;

(f) you are also solely responsible for any consequence, damage or failure resulting from the submission and publication of such information to other Users, third parties or Hello Radius;

(g) you confirm that the information you submit and publish on the Platform is truthful, accurate and up-to-date;

(h) you use the Platform and any information, contact details and Documents (i) for the purpose they are meant and available, namely, in your capacity as an Employer (for finding Job Seekers) or a Job Seeker (for finding employment) and (ii) lawfully and in a way that does not cause damage, violate or infringe the rights of another User or third party;

(i) comply with all applicable laws;

(j) if you are an Employer / Recruiter, you understand that the Account Owner is responsible to manage payments, billing information, subscription plans, as well as authorising and managing additional team member access;

(k) if you are an Employer / Recruiter, you possess any relevant or required licenses;

(l) if you are an Account Owner you are solely responsible to keep your payment and billing information up to date;

(m) if you are a Job Seeker, you understand that by applying to a job posted on our Website or via a hosted careers page created by an Employer /Recruiter who uses our services, that your application will be processed using our screening systems in accordance with our Privacy Policy;

(n) any terms of service or policy by any websites, applications or resources of third parties, including the Terms of Service of Google Maps/Google Earth, whose mapping services are visible and used on the Platform.

You are prohibited from:

(a) using the Platform and the Services to obtain, copy, modify, disclose or distribute information of another User or third party;

(b) creating an account with a false identity or for another person, or using (or attempting to do so) the account of another person;

(c) creating an account with temporary email address. Accounts created with a temporary email address will be subject to immediate deletion and termination without notice;

(d) submit, represent, publish information that is not truthful, accurate or up-to-date or that is unlawful or violates any law, is misleading, harmful or discriminatory;

(e) using the Platform and the Services to damage, violate or infringe the rights of another User or third party, including any intellectual property rights, rights of privacy or professional reputation, to harass another User or third party;

(f) copying sensitive information such as candidate CVs from our system (which is provided solely for the purpose of evaluating Job Seekers within the platform), including downloading, storing, or reproducing this information;

(g) damaging, violating or infringing the rights of Hello Radius itself, including our intellectual property, or use the name Hello Radius and our logos, without our express written consent;

(h) copying any part of the Platform, its contents, graphics, design and software;

(i) using the Platform and the Services and any information, contact details and Documents for any purpose other than that for which they have been intended and designed; and

(j) violating or attempting to violate the security of the Platform.

Hello Radius reserves the right to investigate and take legal action in relation to any violations of the above (including, but not limited to, breaches of data privacy and confidentiality). Hello Radius may also proceed with immediate suspension or termination of an account.

 

Pricing & Payment Terms

These terms apply when Employers / Recruiters pay for Services through their Hello Radius account. You can find more information about our pricing and payment plans on our pricing page and on your account.

 

General Payment Terms

Prices and payments are in Euro. Prices shown on the platform exclude VAT, however VAT will be included in the amount due on invoices, if applicable.

Hello Radius reserves the right to modify the prices at any time.

Changes to subscription prices will not affect users who are already subscribed to a plan. However, any modifications to pricing will be applicable to new subscribers and existing subscribers upon renewal of their subscription term.

Payments on our Platform are done through our third-party payment gateway provider. By making a payment on our Platform, you also accept and agree to the processing of payments by our third-party payment gateway provider.

By providing a credit card or other payment method that we accept, you represent and warrant that you are authorised to use the designated payment method. In addition, you authorise Hello Radius (or our third-party payment gateway provider) to charge your payment method for the total amount of your subscription fees or standalone fees (and applicable taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, you may not be able to use the Services until your payment is processed.

Promotional discounts applied to a customer account are only valid for the service(s) for which the discount applies, as advertised on our Website.

 

Subscription Terms

By signing up to a subscription plan, you agree to a recurring monthly or annual subscription contract with Hello Radius. We only accept card payments for subscriptions.

When you register for a subscription, you acknowledge and agree that Hello Radius (or our third-party payment gateway provider) is authorised to charge your payment method on a monthly basis as applicable for your subscription (in addition to any applicable taxes and other charges) for as long as your subscription remains active, until you cancel it or we stop providing access to the Services, in accordance with these terms.

Customers who created an account before 7 November 2023 will need to subscribe to a plan to continue using the Services.

Subscription Upgrades & Changes

If you change your subscription plan, you will be billed immediately.

A prorated credit from a previous plan and a prorated charge for your new plan may be included in the invoice payment (in addition to any applicable taxes).

In the event you are owed funds, credit will be added to your account credit balance. On your next invoice issued by Hello Radius, credit will be applied and deducted from the total amount due. In the case where the total amount due for a payment is less than €1.00, the charge will be added to your next invoice issued by Hello Radius.

Failed Card Payments

If a recurring payment is incomplete for 15 days, Hello Radius reserves the right to cancel the subscription.

If your payment method is due to expire, our third-party payment gateway provider will notify you by email to update your payment details.

For failed card payments, you acknowledge that our third-party payment gateway provider may retry to charge your card after 3 days of the payment due date and then again after 5 days. If the retry fails, Hello Radius reserves the right to cancel the subscription after 15 days have elapsed.

Cancellation

You may cancel your subscription at any time by accessing your account and following the instructions for cancellation or by contacting us at support@helloradius.com. A cancellation notice must be sent by the designated Account Owner. Inactivity does not constitute automatic cancellation, so unless you cancel your account in accordance with this section, you will continue to be charged for subscription to the Services. All cancellation requests will take effect at the end of the then-current subscription period in which the cancellation request is made, and you will be responsible for all fees and any applicable taxes and other charges incurred through the cancellation date.

Plan Limits

Users that reach their plan limits must wait until their plan renews or until they upgrade their subscription to access additional quotas. Unused quotas will not be carried over to the next monthly or annual billing cycle. If you choose to upgrade or downgrade your plan, and/or change your billing cycle the quotas will be reset to zero.

Company Profile

When submitting a Company Profile whilst on a subscription plan, this will remain active on the Platform (once approved) until you, or Hello Radius, cancels your subscription. When 48 hours have elapsed from the subscription cancellation date, your Company Profile will no longer be visible on the Companies Page.

API Access

If a subscription is cancelled, or is not active, access to any API will fail.

Hosted Careers Page(s) & Widget

By utilising our hosted career pages service(s), Employers acknowledge and agree to be solely responsible for maintaining the accuracy, completeness, and relevance of the content displayed on their career pages.

Employers are responsible for ensuring that the content on their hosted career pages complies with all applicable laws, regulations, and industry standards. Hello Radius reserve the right to review, modify, or remove any content that violates these Terms and Conditions or that we deem inappropriate, offensive, or misleading or that is unlawful.

Employers understand that failure to keep their hosted career page(s) up to date or to address any errors or discrepancies or report to us any technical issues may result in disruptions to their recruitment process.

By using the hosted career page service, Employers grant us the right to display such content on the Platform’s pages.

Hello Radius reserves the right to modify, suspend, or terminate the hosted career page(s) service at any time without liability, and Hello Radius will not be liable for any damages or losses resulting from such actions.

The default Privacy Policy displayed on an Employer’s hosted careers page is the Hello Radius’ Privacy Policy. Employers may add their own Privacy Policy in their account. The period for data retention on the Hello Radius’ Platform and systems / database remains as per the Hello Radius’ Privacy Policy.

 

Free Trial Terms

By participating in the Free Trial, you agree to be bound by these Terms.

Free Trial Eligibility

The Free Trial is available to new customers only. Customers who have previously used a Free Trial and/or subscribed to the Free Plan are not eligible for this offer.

Payment Information

In order to participate in the Free Trial, you must provide valid payment information, including a credit card or other accepted payment method. By providing this information, you authorise Hello Radius to charge your payment method after the Free Trial period ends.

Free Trial Duration

The Free Trial period will be for a duration specified on the Platform at the time of sign-up. During the Free Trial, you will have access to the features of the plan you registered for. This includes usage limits of certain.

Billing

If you do not cancel the Free Trial before it expires, your payment method will be charged at the end of the Free Trial period and your plan limits will be reset to zero. You will be billed the regular monthly or annual subscription fee, as displayed on the Platform at the time of sign-up, including VAT if applicable.

Cancellation

You may cancel the Free Trial at any time during the trial period without incurring any charges. To cancel, please visit the ‘Account & Billing’ section in your account and follow the cancellation instructions.

No Repeated Free Trials

If you cancel the Free Trial during the trial period, you will not be eligible for another Free Trial with the same account. If you wish to continue using the Services, you will need to subscribe to a plan.

Plan Upgrades

If you choose to upgrade your subscription plan or change your billing cycle during the Free Trial period, your Free Trial will be terminated, and you will be billed immediately for the upgraded plan. Any remaining Free Trial days will be forfeited.

Changes to Terms

Hello Radius reserves the right to modify or terminate the Free Trial offer, these Terms, or any aspect of the offer at any time without notice.

 

One-Time Purchase Terms

For any one-time purchase, payment must be made either by card using the payment link provided online or by bank transfer.

Services will not be provided until payment is made and we have received your funds. Payment is required by the due date shown on the invoice (until 23:59pm).

 

Discount Terms

These terms apply only to Employers / Recruiters who pay for Services through their Hello Radius account.

Hello Radius reserves the right to modify the details of discounts offered on the Platform at any time. Changes to the discount will take immediate effect from the date modified.

 

Refund Policy

This section applies to Employers/Recruiters. We are committed to providing you with the best possible experience with our products and services. Please review our refund policy below.

One-time Payments (Non-subscription Products)

We do not offer refunds for one-time payments made for non-subscription products. All sales of non-subscription products are final.

Monthly Subscriptions

We do not offer refunds for monthly subscription payments. Monthly subscriptions are billed on a month-to-month basis, and customers have the flexibility to cancel their subscription at any time without further obligation.

Annual Subscriptions

Customers who purchase annual subscriptions may request a refund within 60 days from the start of the billing period. Refunds for annual subscriptions will be provided on a prorated basis, calculated based on the remaining unused portion of the subscription period.

Refunds to expired or cancelled cards will be handled by your card issuer. Please note that the time it takes for the funds to appear back in your account depends on your bank and their policies.

Requesting a Refund

To request a refund for an annual subscription, contact our customer support team at support@helloradius.com. Refunds will be processed within 14 business days upon approval and issued to the original payment method.

 

Account Credit Balance

This section applies to Employers/Recruiters on subscription plans only.

When you change your subscription plan, prorated credit from a previous plan may be included in your invoice.

In the event you are owed funds, credit will be added to your account credit balance. On your next invoice issued by Hello Radius, credit will be applied and deducted from the total amount due.

 

Job Seeker Terms

These terms apply when registered Job Seekers create a Candidate Profile through their Hello Radius account.

Job Seekers understand that by creating a Candidate Profile, their information will be processed by our screening systems, in accordance with our Privacy Policy, and visible to Employers registered with Hello Radius when they apply to jobs through the Platform. In the case where Job Seekers allow their Candidate Profile to be visible to Employers in candidate searches and suggestions, they acknowledge that Employers can view their information and give permission for Employers to contact them about job positions.

Hello Radius does not review Candidate Profiles for accuracy or truthfulness. The Job Seeker is responsible for any information they add to their profile.

Hello Radius is not liable for any damages to Job Seekers / Employers that may arise from the information submitted by Job Seekers.

Job Seekers understand that if they delete their Hello Radius account, their profile, if one has been created, and any job applications sent through Hello Radius will be deleted within 24 hours.

 

Visitor Terms

A Visitor is prohibited from:

(a) damaging, violating or infringing the rights of Hello Radius itself, including our intellectual property, or use the name Hello Radius and our logos, without our express written consent;

(b) copying any part of the Website or any Platform, its contents, graphics, layout and our software;

(c) using the Platform and the Services and any information, contact details and Documents for any purpose other than the purpose they are meant and created.

Hello Radius reserves the right to investigate and take legal action in relation to any violations.

 

Rights and Responsibility of Hello Radius

Hello Radius may access, store, process and use any information and Personal Data that you provide in accordance with the terms of the Privacy Policy.

Hello Radius has the right to review the information submitted in a job advert or in a Company Profile, for up to 24 hours from the time of submission. However, Hello Radius is not obliged to verify the legitimacy and truthfulness of such information and is not responsible for content or information provided by Users or other third parties.

Hello Radius reserves the right, at its sole discretion, to remove a job advert / Company Profile from our Platform (and/or the accounts) without written consent from the User for any other reason, including if a job advert / Company Profile or use of the Platform or Services violates any term or condition in our Contract.

Hello Radius is not responsible for any misuse of the Services or content available on the Platform or for the performance or conduct of any User or Visitor.

Neither the Employers / Recruiters nor the Job Seekers are employed by Hello Radius and the use of the Platform and the Services does not create an employment agency, or joint venture relationship between Hello Radius and any Employer / Recruiter.

If an Employer / Recruiter edits a job advert / Company Profile that is already active on the Platform, the job advert / Company Profile will automatically be resubmitted to Hello Radius for review and will not be visible on the Platform until approved again.

Re-submission of a job advert / Company Profile does not extend the initial service period (from the date of initial publication).

If an Employer / Recruiter wants to delete or edit a job advert, remove a company logo or profile, or delete their account, Hello Radius can carry out these actions, only when the Account Owner has provided their written consent.

When an Employer / Recruiter account is deleted, Hello Radius has the right to remove access to all users associated with the primary account.

When an account is deleted, Hello Radius has the right to store details contained within a job advert in accordance with the terms set out in the Privacy Policy.

Hello Radius has the right to review logos for up to 24 hours from the time of submission. Approved logos are visible on the Platform’s designated rotating logo carousels for 60 days from the date published. Hello Radius cannot control whether a company logo submitted by an Employer appears next to a logo of a competing business/company.

If a User deletes their account, any Company Logos that feature on the Platform, will remain until their expiry date.

Hello Radius has the right to review Company Profiles for up to 24 hours from the time of submission. Hello Radius cannot control whether a Company Profile submitted by an Employer / Recruiter appears next to a profile of a competing business/company.

 

Limitation of Liability

Hello Radius has no responsibility to check the truthfulness, validity and availability of information on the Platform and we are not liable for any untrue or invalid information.

To the extent permitted by law, Hello Radius does not have any responsibility or liability under this Contract or otherwise for any loss of profits or business opportunities by either Job Seekers or Employers / Recruiters or other third parties, for any loss of data or any damages by any Job Seekers or Employers / Recruiters or other third parties from use of the Platform and the Services.

Hello Radius does not warrant to any User, Visitor or other party the job adverts and details thereof, job opportunities, the Candidate Profiles, services, employment or other information published by Users or otherwise available on the Platform.

Hello Radius is not liable if the Services on the Platform do not result in a Job Seeker finding a job, or being employed, or an Employer finding or hiring an employee.

Hello Radius does not review Candidate Profiles for accuracy or truthfulness. The Job Seeker is responsible for any information they add to their profile.

Hello Radius is not liable for any damages to Job Seekers / Employers that may arise from the information submitted by Job Seekers.

 

Intellectual Property

Hello Radius reserves all of its intellectual property rights in the Platform. Any logos, trademarks, graphics, and the Hello Radius name are owned by Hello Radius.

However, names, trademarks and logos of an Employer or a company that uses the Platform and the Services belong to such owners and afford Hello Radius a right to use them for the purposes of the Services; for example, advertising job posts on behalf of the Employer and promoting the Employer.

Similarly, the names, trademarks, and logos of companies whose services Hello Radius uses on our Platform (such as Google, Facebook etc.) belong to such owners.

A User or Visitor cannot use any name or logo shown on the Platform without the prior consent of Hello Radius or any other copyright holder.

 

Termination or refusal of Services

Hello Radius may refuse to grant a password or may cancel a password or terminate provision of Services to a User and refuse any current or future use of the Platform and the Services in the event of violation of these Terms and Conditions or any law.

In such a case, we will not be liable to you or any third party.

 

General

If any part of these Terms and Conditions is found invalid or unenforceable, that part will be considered as removed while the remaining Contract shall remain unaffected and in force.

This Contract (including additional terms that may be brought to your attention) is the entire agreement between Hello Radius and the User and Visitor (as applicable) regarding the Services.

Any failure by Hello Radius to enforce any right or provision in the Contract does not mean that Hello Radius waives such right or provision.

If Hello Radius exercises any remedies under the Contract, this does not affect our right to seek other remedies under the Contract or under the law.

Hello Radius is not responsible or liable for any aspect of any third-party websites, applications or resources, and links of third-parties available on the Platform.

Besides the Documents created and/or uploaded by a User, the Platform and all copyrights are exclusive property of Hello Radius and or the Company, or their legal licensors.

 

Applicable law and jurisdiction

The Contract and use of the website are governed by the laws of the Republic of Cyprus. The Cyprus courts shall have exclusive jurisdiction in connection with any dispute arising in relation to the Contract and the Services.
